    Hi,

    I just came in yesterday evening and I did not have any problems while entering the country at POE. I applied for I-485 on Aug 17th and left US on 24th. I have a valid VISA stamping till June 2008 but got a different H-1 transfer visa I-797 till jan 2010.

    The officer at POE didnt ask me any single Q and he simply let me in with a new I-94 (he noted the new company name on the back of I-94 as usual).

    Immigration Law from Houston Immigration Lawyer - Annie Banerjee Has Just Posted the Following:


    Today's Wall Street Journal has their main front page article on how H-1B quotas have not been used up yet and argues that the market should dictate the numbers rather than Government quotas.

    Arbitrary quotas have been ruled unconstitutional by all courts in every domestic affairs except for immigration law. You cannot have quotas for segregation or desegregation, for diversity in public education. You cannot have quotas at workplace. We read in Law School that quotas inherently violate due process. But I had to throw my constitution down my office window when I started practicing immigration law.

    When the colonists came to America, there was no problem, no quotas. White Anglo Saxon Protestants could simply come and work. Then as more and more Italians and Chinese came in, restrictions began to be put in from 1875 onwards. Chinese were banned because they were "Coolie labor" for lewd and immoral purposes. After World War 1, the Congress restricted immigration to 2% of their nationality already settled in America. Since there were no non white people in the US at that time, most of Asia and Africa was shut out from the US. This was done to preserve the racial mix in the United States. Since then a lot of restrictive immigration Acts establishing arbitrary quotas were enacted and still valid today. The Permanent Residency Process has quotas in both Employment based and Family Immigration. So does the H-1B program for bringing in the brightest and the best.

    These quotas have risen from anti Immigration and Xenophobic attitudes prevalent in America. As the Wall Street Journal points out, why should a very bright person from say India or China come to the US to be treated as a second class citizen, at the bottom of the social ladder? They would rather stay in their own country which are emerging economies. Yet, as the WSJ articles point out, 35% of Microsoft patents were developed by immigrants, and the person who developed Google News was an H-1B from India.

    Those patents will just go to India, and someday the children or grandchildren of these anti immigration forces will seek immigration to India.

    The number of American citizens and green-card holders severing their ties with the U.S. soared in the latter part of 2009, amid looming U.S. tax increases and a more aggressive posture by the Internal Revenue Service towards Americans living overseas.

    According to public records, just over 500 people worldwide renounced U.S. citizenship or permanent residency in the fourth quarter of 2009, the most recent period for which data are available. That is more people than have cut ties with the U.S. during all of 2007, and more than double the total expatriations in 2008.

    An Ohio-born entrepreneur, now based in Switzerland, told Dow Jones he is considering turning in his U.S. passport. Mounting U.S. tax and reporting requirements are making potential business partners hesitate to do business with him, he said.

    I am on the same boat...my wife got H1 approval recently without COS, and H4 extension applied two weeks ago (on top of it I-485 has been applied).

    My lawyer suggested to file for H4 extension to cover that gap that is there before H1-B takes effect i.e. October 1st (or she will be Out Of Status). And after October 1st, revoke the H4 petition.

    As soon I got the receipt number, I started working for Company B. Now I have paystubs for almost 8 months. With those pay stubs, can i transfer to company C? If Company C files for a H1 transfer, with which H1B receipt will he file for transfer-H1B approval copy of employer A or H1B receipt of employer B? My attorney feels that my H1 transfer petition with Company B has got stuck in a security/background check, since USCIS has not responded to 2 SR's placed by my attorney and added that PP will not help if my petition got stuck in security check.

    USCIS is a fee-based organization with about 90% of its budget coming from fees paid by applicants and petitioners to obtain immigration benefits. The law requires USCIS to conduct fee reviews every two years to determine whether its costs to administer the nation�s immigration laws, process application, and provide the infrastructure needed to support those activities. A fee adjustment, as detailed in the proposed rule, is necessary to ensure that the USCIS recovers the cost of their operations while also meeting the application processing goals identified in the 2007 fee rule.

    Members of the public are encouraged to submit comments and/or suggestions to USCIS.

    Dear Friends,

    First of all, I'm really thankful to immigrationvoice.com to create such a lovely community.

    My question and your advice

    I'm currently working in Company A, My first 3 years visa is going to get expire on SEP-2009.
    My current company has some issues, so If I apply my extension through my company I won't get my extension for sure.

    So I contacted Company B , and applied for my H1 Transfer, they filed my H1 Transfer on 04/10/2009 through normal processing. I would like to know whether I need to switch from Normal processing to Premium Processing. If yes, then what's the procedure. I really appreciate all your time and efforts in answering my questions.

    Unfortunately, a 212(a)(3)(B) finding would also prevent you from getting a GC based on your marriage to a US citizen.

    You are entitled to renewal of your EAD as long as your GC remains pending.

    The basic fact is that people come here to save money, otherwise they'll hire an attoney for their immigration need. So it is bond to be hard to ask money from them.

    But I think they'll be glad to do so if they were asked to click 10 times on an ads everytime they visit this site. Will this make money?

    Another thought, maybe IV can make something for sale on this site. It's always easier when there is some sort of medium, cookies, fund-raising diner, fund-raising concert, etc. Just simply asking for money seems not work that well.

    Just some thoughts, you guys have good judgement.

    Gap in employment and porting priority date:

    What if there is a gap of employment between leaving the previous employer who made the initial green card application under EB3 and joining the new employer who is willing to make a new application under EB2.

    I-140 is approved, I-485 was pending for more than six months when the employee left the first company and has had a gap in employment for a few months. The employee has joined the new company using EAD. I-140 has not been revoked.

    Would applying for the green card under EB-2 and trying to port the EB-3 priority date cause any complications given the gap in employment. The new job satisfies the same or similar job requirement with a 50% bump in salary and meets the EB-2 requirements. Would really appreciate your insight on the risks to be aware of if any due to the gap in employment. Thanks!

    You need your employer's approval, without them you cannot change the attorney. If employer's says yes, then you can switch attorney.

    I got my H1b tranfer in premium processing approved in 2 days, 2 days for receipt notice.
    So all process is with in 1 week. This is for Vermont center though.

    Hi,
    I have recently received an RFE on my I-485 application asking me to provide receipt number or A number for my spouse and child as I have included them in my application. I don't know how to respond to this and need your help to provide a suitable response.

    I didn�t submit I-485 application for my spouse and child as they were out of the country while i filed my mine. My family continues to live outside US while I'm here working on H1 and also have my approved labor (Feb24 2007) EAD (Nov11 2007) and I-140(Feb10 2009)
    Question is how to respond to RFE as I can't provide A number or receipt number. Also as my spouse and child are born in a country where they still have visa numbers available, can I claim cross chargeability to my spouse country of birth as the visa numbers are not yet available for India for my Priority date.

    As I have my chances of speedy processing with cross chargeability, how should I respond to RFE without I-485 filed for my family? Is it possible to ask for consular processing for my family with an intend FTJ? Please help me to answer in a way that would help my processing faster.
