IMO: 7th Year extn can be filed if PERM is pending for more than 365 days or if I-140 is approved.
You can also get 7th yr extension with approved labor. With approved I-140 you get 3 yrs of extension.

We applied on June 15th (TSC) still waiting...currect EAD exp. next week :(
I applied on Jun6th and got my EAD 2 weeks back. I took infopass to expedite the process. The IO wrote an email to someone in TSC. I got approved next week. Give a try taking Infopass.

Certain felonies make a person inadmissible, which means no Green Card may be issued for such a person for either 15 years of indefinitely. You need to be more specific. Crimes of moral turpitude are inclusive. There are some limited waivers for some, but not all grounds of inadmissibility.

Hi,
My wife is stuck in Bangalore right now, as she was give a 221(g) pink slip on the 16th of Jan, 08. She's actually at school, with about 7-8 months left for graduation. She's getting a Phd in Molecular Biology. Spring semester has already begun, and she's missing a lot of research, and teaching.
When is a good time to contact the consulate? Many 221(g) cases even after her interview date have been cleared. I wonder what the hold up is.
Also, can you please elaborate on the PIMS and Security Clearance issue?

If I-140 is approved and priority date is current is it possible to keep on extending H1B for couple of years without applying for I-485? I am asking this quetion because my employer is not allowing me to apply for I-485 as my I-140 is pending. It looks like he want to use me for couple of years on H1b.

i have read some place in this forum that as long as you maintain your full time primary job you are entitled to use your ead for other smaller assignments without losing your H1 status. But then again I am not a lawyer just sharing what I have read.
AFAIK, Using EAD either for a FT or PT job should invalidate other non-immigrant work authorization documents like H1B since EAD is a derivative benefit of filing for immigrant status and you cannot mix and match your status...
If this is not true and there is a discussion on this forum clarifying that, I would like to know too...

the webfax letter is great and articulate and I dont undermine its value. But what i meant was another one based on just the hard country quota dilemma/eb3 ;A petition highlighting that even with the pro provisions our status will remain unchanged unless a amendment corrects it or provides a interim relief.
I dont think the fax would motivate any senator to present a amendment on the floor.It would surely educate and maybe earn their sympathy but would it do any good for our numbers??
A hard copy with full name,city,state of all members ..would that not mean a little bit more to them.I am not debating the work put in by the volunteers /admins its value is unparellel and hats off to all of you.
But the situation is getting so desperate that no measure seems inappropriate right now. Shoot all your arrows atleast one may strike or hit close to the aim!

If I dont transfer my H1B for a couple of years then what happens. So for example I get a job today and start working on EAD and there for a 2-3 years just by renewing EAD via my husband. Three years down the lane I want to get back on H1B due to problems with I485. Is it possible to get on H1B at point in time because I still have three years remaining on it. WOuld the cap be applicable? In addition, if we find out there is a problem with I 485, does INS give me some time like 1-2 months to make that change in status that is from AOS to H1B?

The issuing of U visas comes at a tense time in the national immigration debate, amid a polarizing crackdown and potentially broader policing powers against immigrants in Arizona. And it illuminates a prickly point of justice: Should the federal government give illegal immigrants special treatment for a societal good such as fighting violent crime?

I mailed my first EAD application in the last week of Dec/09.
Never thought it would take so long for receipting, and worried something wrong in my application..
Good to see others ...
Will wait further then..
Next time will go online..although it requires a trip to local office for biometrics
