I am on H1B in USA and now I am planning to set up a company in India. Will I be violating any laws by doing this.
Can I operate the company from USA and still get payed in India. My clients will be paying my company in India.
Will I have to pay taxes in USA.

Here is the answer - If you stay more than 6 months in US, you will have to pay taxes exception will be only L1 VISA. But before you think of L1, read L1 Visa requirement rules.

Question to Mr. President:
In the world of so called "Equal Opportunity" I wonder why we have country quota on employment based green card system.
And on top of that I really have no idea why the concerned authorities can't recapture thousands of wasted employment based visas in the past.
Mr. President, I am sure that once the employment based green card is being taken care of there will be thousands of immigrants becoming proud permanent resident and will not hesitate investing in houses/cars/etc to give the much required boost to the economy.
I'll request you to please provide your kind cognizance on the much awaited employment based immigration relief.

Now I have more than 5 years of US experience, will I fall into this category when I file I-485.
It means a shit if a bill doesn't pass. As of right now, news reports have started suggesting that there may not be any immigration bill this year, which could imply - no immigration bill until 2009.

If you do the paper file for which you submit all the initial evidence and supporting docs, you dont need to do finger printing.
but if you do e-file then you will have to go for finger printing.
Anytime you do your finger printing it is valid for about 15 months.
For me too I gave my finger prints in Nov 2007, but still USCIS sent me FP notification for code2 Finger printing.
by the way USCIS's RFE for me turn out to be that they dont have my code-2 finger prints in their system, so they need to know the details about my FP appointment and what's the schedule.
USCIS processing is really goofed up for e-filed applicants.
This is my personal expereince and their are lot of other folks who filed around the same time frame are facing the RFEs for fingerprints.
anyways i am going to respond to my RFE once i complete my biometrics on august 22nd 2008, by that time i will have the acknowledgement from the Seattle, ASC that they indeed complete my code-2 FP for the EAD purpose.

Although, I don't deny the requirement of processing and legal fees, I disagree on how employers (sponsors) and lawyers/attorneys handle them. Employers on one hand should cover without split or sharing the expense with the employee; just because of the fact of getting our salary -kind-of-locked-.
In the other hand, attorneys ...the ends justify the means...
I think that I am just frustrated with the whole process, MAYBE 20K wouldn't really matter if we were seeing results but we have to beg for an action/update or even worse lay around for who knows how long so the "system" can work.
If I had known what I know now... :rolleyes: everyone's wish!

What is the difference between L1B and H1B? Why don't companies hire on L1B when H1B's are over? Thanks.

Now a days there is restrictions like only computer back ground people need to apply for L1 ( BE/B.Tech in CSE,EEE,ECE) on this because companies are misusing it for no annual cab.
Since it is company transfer H1B is not eligible for L1B ( you have to work in the company home country for 1 year to be eligible) but L1B is eligible for H1b. But many of the Indian companies are not sponsoring green cards for L1A and L1b of then do then they will also face retrogression.

Confirmation receipt which you got after submitting the application
copy of i485 Receipt notice
2 recent color photos
a copy of any govt issued identity document (visa , pp biographic page, ead card, etc)
current i94 copy

I did check the USCIS website for the July 17, 2007 (reinstating the July Visa Bulletin) and July 23, 2007 (about I-485 fees) notices that are specified on murthy.com link you provided, but did not find them. So if any of you know how and where to get them from please let me know. Appreciate your help. Thank you.

In you case, lets say company B decides to let you go .. then at least you should get them to agree to give support till 140 comes thro'

Thanks So Much Ann, That gives me direction and what to request my employer when I talk to them later this afternoon.
I have one more question? When I spoke with USCIS and opened the inquiry in dec 2010. why did they come up with " RFE resposne not received till todate?" Do you think thye just checked the online status and responded back. My lawyer says that they spoke with someone at Texas service center and they told them that they have received the response. Thanks

I know 485 cannot be filed without PD being current. Can one do consular processing without being dependent on PDS:p

Actually sometime when you talk to IO, they tell you all the receipt numbers including I-140. It happened with me once. I was inquiring about my I-485 receipt notices and the IO started telling me all the cases , I have filed so far. I guess, when they pull informaton based in your DOB and name, they are able to see everything. At this time, you can request them the RN of I-140. There are bright chances that you get the I-140 information.

I saw LUDs yesterday and day before yesterday on my AP application..
Hope they approve it soon.
Well I saw the LUD change a couple of times last week but No change in status.... this is goddamn ridiculous, it has been more than four months and no AP yet, people are prisoners or what .. *Go@ Dam&^% !!!
