We recently moved our place and we are now in a new apartment.
We have immigration matters that needs to be updated but we don't know what we should do?
The following are affected
1. EAD
2. H1B
3. AP
4. I 485 related things.
My Ead and Ap has old address and the card also holds the same old address.
Could you please tell me what steps I must initiate to get this straightened out? Do I need a new EAD card? Please help me.

I just spoke with Siva, and the funding might not be the issue with DoL. This might be a case of the "mythical man month" (training more people takes time).
If USCIS think it practical then keeping priority dates may be something that the law makers will consider.
Maybe law makers would consider allowing concurrent PERM filing while waiting for BEC.
Soon we will have an opportunity to call the DoL on their word. They have estimated all data entry will be done by end of June. If they don't have it done for then the law makers may be more receptive to further measures. The lack of concurrent PERM filing is I think an administrative rule, and thus if DoL does not shape up with regard to its estimate of end of June 2006 for data entry, then the law makers could very easily override the adminstrative rule. The trouble then might be that PERM is flooded with 100,000 applications. So portability of priority date looks to be the best bet with essentially zero cost in terms of fees, queues and administration.

Thought folks might find the following interesting.
I recently returned from a visit to Canada where I stayed with my brother-in-law, who owns a small but very successful web development shop. He told me that due to the booming Canadian economy, he can no longer find experienced programmers at reasonable bill rates. So he's been doing some outsourcing to get cheap foreign labor ... hiring American programmers !

Let that Champagne sit in the chiller for while. These numbers are a blip on the RADAR. Don;t expect some real job creation 'tll 2011 (or later). The private sector has to start spending and creating wealth. Government spending never causes any growth. We have all seen what Indian economy was like, in early 1990's and before that, with Government runnig it.

If you are Canadian Citizen (by birth not naturalized) it should be pretty quick, maybe 6-18 months depending on FBI name check timing.
You should get your EAD 10-12 weeks.
I am not sure about one thing. As I know visitor visa doesn't have an immigrant intent, is that a negative or neutral in your instance.
As far as priority dates go Canada has always been current.
All the above I said is based on very little specific input about your case. Let some guru chime in who has been on this path already.

Yes that�s a good suggestion. We need more people than whose GC is stuck. One issue is motivating them. I was almost shocked to see the indifference of many immigrants � some of them who went through the same process very recently. I came here almost 10 years ago as a student and many of my friends got GC�s/citizenship (they had their own hassles but now its over). When I talk to them what is going on now � they simply express surprise over how/why I didn�t get it even now and forget it. But I don�t feel bad to remind them again to visit this site or something else and do something (sending faxes /talking to their employers / contributing money/ whatever they can). My point is � don�t expect an immediate action from any, even friends � especially if this does not affect them; but don�t let this discourage you. Engage them in a discussion � most of them already know the terminology like retrogession/140/485/labor etc � remind them their own process and how difficult it was and how finally there is a systematic effort to do something about it. I am sure at least some people will respond favorably.

This is an option given to me by my lawyer - I can change job within my company to a differenct category, even though Green Card Process has to be restarted, we can port the priority date. So it is an option....

My friend works as an internal auditor within a big 4 acccounting firm. His practice is doing quite badly. As there are tons of different practices within this firm, he is thinking about transferring. But his PERM was filed for the internal audit manager position and his I-140 has alreday been approved. If he transfers to a function unrelated to internal audit within his firm (e.g. external audit, tax, fraud, etc.), would there be a problem?
Can anyone here provide some guidance or point him to the right discussion thread?

My wife has her H-4 visa expired. She has her papers(I-797) valid until Dec 2010.
My firm plans on filing an extension for my H1 and my wife's H4 next month. Is it ok for her to stay in India while the H1/H4 extension is getting processed?
Is it ok to travel via Frakfurt? Would she need a transit visa?

Yes. We faced this problem once. She should either stay in India or the US until the H4 approval notice comes through. Try not to travel after the extension application is filed.
Remember that if she is in the US, then you will submit her current I-94 which will be renewed by USCIS and that will also appear at the bottom of the I-797 approval notice. If she travels back to the US, then she will get a new I-94 (new number) that will expire in Dec 2010 (she will need a new visa stamp to travel, BTW). You then have to go through the additional steps of sending that to USCIS and/or filing again for extending the "new" I-94.
I don't know for sure how big of a problem it is, but I think it is a big problem to have an I-94 that does not match what is on the approval notice.
If she stays in India, however, then she will get a clean H4 approval notice....No I-94 problems there.
But please check with your lawyers too..

I have my labor cleared and 140 applied in 2007. Later in 2007 I had filed for 485 based on the pending 140 application and received EAD as well. But the 140 was denied later due to ineligibility to file on EB2 and a new one I140 was applied in EB2 refering the pending 485 application and the same old labor. This I140 has been pending since last few years and my attorney only received a letter stating it is under review, when a SR was raised. Meanwhile I have received EAD and AP extensions properly based on the pending 485.
I would like to apply 140 again from a different company using the old labor and refering the pending 485 application sine i am currently on EAD using the pending 485 application.
Questions
1. Can i do that?

i'm no pro, but i think the first is much better then the second. the framing of the image is a bit off, but to me that's what makes the image.
There's no right or wrong really, just some de facto rules or guidelines - sometimes an image can be more interesting if those rules are broken. I guess it comes down to personal taste.
